Still in our home! Empty Still in our home!

We live in Alberta, north west of Calgary and we have been sending letters since last August 2012 in a foreclosure case with Citifinancial Canada Inc. and when we got the OPPT info we started sending the courtesy notice with our letters about a month and a half ago. I already had them in a tacit agreement with an Estoppel by acquiescence which is remedy in common law but I do believe the courtesy notice has given our paperwork a punch! The Order to Vacate the Premisses was for March 2 and we haven't heard anything to date so I will keep you posted.

Hi Nancy,

Thank you for your posting. Can you help me with the PPSA financing statement. I have had to vacate my property on February 26,2013. I have to pay the arrears to get my house back. \my question is: "what papers do I need to submit to PPSA to transfer the title deed to my name once I claim my house back?

Thank you in advance for your help. Smile

Hi freedomseeker,
I am researching that right now myself so in short I do not have the answer. I have talked to Caleb Skinner and he is getting Heather to send me the UCC Filings where she entered her house and car. Do you know how to do a PPSA filing? As an example I would think that you lien the house under debtor individual, for instance I would call my home Domicile and land with the latitude and Longitude co-ordinance then the legal address. Under collateral description is where you put all your details about the buildings, land and your claim to it. My claim is that I am steward under God and I have many examples proving my claim that I have already used in documents to the court. My understanding is that there is no need or requirement to register anything anymore and that there are no more titles or deeds, which were instruments of fraud and the old slavery system. However I am doing a PPSA so I have something in writing to produce if the need arises.
Is your home sitting empty? If it is and I were you I would move back in, break the lock. Do a PPSA lien for the house and property then send courtesy notices to all the potential actors who may approach you in the future. Most would think that would be scary but I am not scared of them so that is just my opinion.
Love,
Nancy

Still in our home! Empty Re: Still in our home

Hello Darren/Nancy

I sent you a PM in response to your reply posting. Thank you for your help.
Yes, the house is empty. I have to be brave to carry out what you suggested. My family thinks I should just get my house back and not do anything that will allow the bank to sell my property. At this point I don't know how to stop the foreclosure as some people in the United States are saying. Does anyone knows how to stop foreclosure in Canada?

Will appreciate any help you can give me.
Thanks in advance.

Hi again freedomseeker I had a bailiff come to my home last Wednesday and he told me he was going to change the locks the next day at noon. I had a conversation with him then faxed an OPPT courtesy notice to his offices and no one has come back or called. I would be happy to help you but I would ask you to PM me your number and 3 good times to call so I can call you because it is too difficult and lengthy to do back and forth by posts like this. Where are you in Canada? I am in Alberta near Calgary.

Still in our home! Empty Not In Our Home Anymore!

Post  DarrenNancy Thu Apr 04, 2013 7:22 pm

On Monday March 25, 2013 we were forcefully removed from our home by a bailiff and 4-5 RCMP officers from the Didsbury Alberta detachment.
I was arrested for contempt of a court order and held in solitary confinement overnight. The court room was cleared at 12 noon the next day before they brought me in and all I got on record was I do not consent then I was almost completely ignored. I was asked if I was a member of the Free-man-on-the-land movement. I was told that I was going to be given the max sentence of 2 years unless I could convince justice miller, calgary court, that I would not break into the house and violate another court order.
I am now working on cancelling the previous court orders.
Love,
Nancy
